Settlement by Agreement

 

Under section 22A of the Surveying Act 2004 the Board is empowered to arrange to settle a matter regarding the professional conduct of a licensed surveyor by agreement. 

 

The Board will only consider exercising this power where the licensed surveyor has admitted during a preliminary investigation (whether under section 22 or otherwise) that he or she has engaged in unprofessional conduct in relation to the relevant matter.  Under these circumstances, settling the matter by agreement negates the need to arrange and conduct disciplinary hearings. 

 

Such matters may include complaints lodged against licensed surveyors or other professional conduct matters concerning licensed surveyors notified by third parties or raised by the Board.

 

As part of the agreement between the two parties, the licensed surveyor is not identified on the Board's web site or in any Board publication.  Further, the licensed surveyor undertakes to comply with the terms of the agreement and acknowledges that breach of the undertaking may result in the Board taking any action that is necessary to implement the agreement or instituting a formal hearing into the licensed surveyor's professional conduct in accordance with s.22A(3) of the Surveying Act 2004.
