Voluntary Restriction
Surveyors subject to Voluntary Restriction or removed from the Register of Licensed Surveyors
Background
The provisions of the Surveying Act 2004 require that only those surveyors who are currently registered as licensed surveyors with the Board can undertake cadastral surveys and certify cadastral survey documents. Due to the extended timeframe of many surveying tasks, situations may arise where a surveyor has accepted Voluntary Restriction (will not undertake cadastral surveys) or has been removed from the Register in accordance with the Act, but there is a subsequent requirement to make amendments to, or complete a survey that he or she undertook while registered.
In these circumstances, it is clear that a surveyor who is registered with Voluntary Restriction status or who is not registered with the Board cannot certify amended cadastral survey documents as a licensed surveyor.
Responsibility
A surveyor who is unregistered or registered with Voluntary Restriction status should not promote himself/herself as a practising cadastral surveyor.
In order to ensure the timely delivery of surveying services to the community, it is the professional responsibility of the unregistered surveyor, or a surveyor who is registered with Voluntary Restriction status, to arrange for a registered licensed surveyor, not subject to Voluntary Restriction, to undertake the required tasks to finalise a survey. In doing so, the registered licensed surveyor is accepting responsibility for this survey and should ensure that it complies with all regulatory standards.
